General Terms and Conditions for Booking

These general terms and conditions regulate the use of the websites of DSG Viajes (Destinos Sin Gluten) hereinafter WEBSITE or WEBSITES whose addresses are: http://www.destinos-singluten.com and http://www.destinos-singluten.traverltool.es, through which Destinos Sin Gluten, S. L. (hereinafter Destinos Sin Gluten), a private limited company with its address at Calle Juan Bravo 66, 28006 Madrid, and with tax ID number (CIF) B86873338, markets its products and services.

In this document, USER refers to any individual or legal entity that accesses these websites to obtain information and/or contract any of the products or services that are offered on them.

Before making a purchase, the USER must read and understand the general conditions as specified below. as well as any additional information and the specific conditions regarding the product and/or service that the user intends to purchase or adquire.

1. Products and Services marketed by Destinos Sin Gluten

Destinos Sin Gluten serves merely as a intermediary between the User and third-party providers, such as tour operators, airline companies, hotels, etc.

The sale of products through the WEBSITES is not generally set up as a direct offer from Destinos Sin Gluten, but as an offer to the USER so that he or she can purchase an offer provided by some of its suppliers. Destinos Sin Gluten can accept or refuse said offer on behalf of the supplies and/or ask for more information from the USER.

The  responsibility for all the information contained on the WEBSITES lies with a number of companies (travel agencies, tour operators, airlines, hotels etc.), and they have the right to modify any information connected with their products and offers.

2. Price Variations.

Prices can be revised as a result of modifications to tariffs and/or possible exchange rate fluctuations. The VAT / Canary Islands tax or any other applicables taxes are included in the published prices on the WEBSITES.

3. Accuracy of the data provided by the USER.

The USER must ensure that the data they provide, either through the WEBSITES or our Customer Service, is true, accurate and complete; in particular regarding credit cards and other payment methods used to purchase products.

Destinos Sin Gluten reserves the right to cancel the reservation in the event of the non-payment of the price, refunds, if the payment is rejected, if information provided is false, or if it is impossible to verify the above.  The USER should inform of any change to said data.

Any additional costs resulting from the rectification of data shall be borne by the user, unless the error is attributable to Destinos Sin Gluten.

4. Making a Purchase.

The products and services advertised on our WEBSITES can be purchased via the Intenet, as well as through our Customer Service.

The USER requests the product or service with the best price available at the moment of purchase. This way, and unless otherwise indicated, when the USER purchases plane tickets or package tours, the best price will be offered by default (Tourist Class), without the option to cancel or change it.

4.1. Making Purchases through the WEBSITE.

The complimentary products and/or services offered to the USER whilst making the purchase can be accepted or refused without affecting the initial selection in any way.

Customer Services may contact the USER in the case of a problem with the reservation. If it is not possible to locate the USER in order to resolve said problem, the reservation may be cancelled.

4.2. Making a purchase through Customer Services.

If you decide to make a reservation through Customer Services, our operators will guide you and suggest offers which best adapt to your needs, as well as their conditions. At the same time, you will be advised of the features of the product that you intend to purchase.  Costs incurred for any errors made during the reservation process shall be borne by the user, unless the error is attributable to Destinos Sin Gluten.

This should be the preferential option for all those people who have special requirements.

In the case of people with Coeliac disease, only a small amount of those hotels that appear on the WEBSITES can be adapted to their dietary needs. Therefore we strongly recommend that these people only use the online reservation method if they do not have any dietary limitation, or if they know for sure what products they wish to choose.

5. Quotes.

While making a purchase on the WEBSITE, it is possible to save the quote. However, given that this quote depends on a number of variables, such as the number of places available, rates charged, etc., Destinos Sin Gluten cannot guarantee that the price reflected in this quote will remain the same when confirming the reservation.

Additional costs, such as checked baggage fees which may be charged by airlines, or fees incurred when paying by credit card, are not included in the quote.

6. Confirming the Purchase.

You will receive the confirmation of the reservation via email. This will confirm the contract and the product or service which the USER has purchased through the WEBSITE or our Customer Services.

7. Information about passports, visas y vaccinations.

Each and every one of those travelling (including children) should take the personal documentation required, ensuring they have not expired, while taking into account the laws and regulations of the places they are going to visit. At the same time, before leaving, they should make sure they have all required documentation such as visas, previous records, vaccinations etc, which are necessary for the country they are travelling to.

Under no circumstances can Destinos Sin Gluten be held responsible as a result of any problems arising from this documentation.

The traveller will be responsible for obtaining all the necessary information and ensuring that they have all the required documentation.

8. Flights.

8.1. General Information.

Destinos Sin Gluten acts as an intermediary with the airline companies. As these companies are those who determine the rules and regulations which affect your journey, you are recommended to carefully read the conditions that are given in the documentation provided with the ticket.

The USER will completely lose the right to a refund or change of ticket if he or she does not arrive at the correct place at the correct time and therefore misses the flight, without having previously cancelled.

8.2. Prices.

The total price of the flight will be shown separating the airline’s base price, the taxes and the administrative fees of Destinos Sin Gluten. The airline companies have the power to change their tariffs and conditions at any moment and without prior warning. The price will be guaranteed once the reservation and payment have been completely carried out.

The USER is assumed to have requested the cheapest flight on the dates and times selected. For this reason, unless otherwise stated, the cheapest price will be offered, without their being an opportunity to change or cancel it (tourist class with restrictions).

It is forbidden to use the ticket other than in the agreed way. It will not be possible to go on the return flight if the outgoing flight ticket has not been used.

8.3. Bookings.

Some airline companies do not update the current availability on their booking systems. Destinos Sin Gluten will do their best to keep the information as up-to-date as possible, but the airline company may rebook you if there are not enough places available for your choice. In this case, we will get in touch with the USER to inform him/her of the change and offer an alternative.

8.4. Administrative Fees.

The administrative fees are those charged for the administration of the reservation and issuing of the tickets. Said fees are charged per person, vary according to the price of the tickets and are not refundable.

8.5. E-Tickets.

All flight tickets purchased through Destinos Sin Gluten will be sent to you as E-Tickets.

Therefore, it is essential for every passenger to have printed a copy of their E-ticket before arriving at the airport and checking in. Under no circumstances will Destinos Sin Gluten be held responsible for the USER not following this procedure.

8.6. Reconfirmation of flights.

The airline companies have the power to reschedule their flights. The airline is however obliged to put you onto another flight if there has been a change or cancellation, or indeed refund the passenger with the full price of the ticket in the event of a considerable change in the departure time.

Destinos Sin Gluten operates as an intermediary with the airline companies, who are responsible in these cases. It is recommended that you reconfirm the flight 24-48 hours before. You can do so by contacting Destinos Sin Gluten or directly with the airline itself.

8.7. Arrival at the Airport.

It is the USER’s responsibility to arrive at the airport in sufficient time as recommended by the different airlines.

Destinos Sin Gluten does not take responsibility for any complaint following the holiday or flight if these requirements are not met.

8.8. Resident Discounts.

Those residents in non-mainland Spanish territories who wish to apply for the resident discount should prove their residency with the following documents:

•  Spanish Citizens: the certificate of residence issued by the town hall where you reside, along with your national identity card or passport.

•  Foreign Citizens: the certificate of residence issued by the town hall where you reside, along with your national identity document or passport.

These documents will only be valid for the resident discount if they have not expired.

The status of being a resident should be declared during the purchase, as once the purchase has been finalised, the discount will no longer be available. In the case of low-cost airlines, we recommend getting in touch with our Customer Service Department (913 095 456) beforehand so that the discount can be applied.

8.9. Conditions and fees for Changes.

In order to make changes to the ticket, it is necessary to get in touch with our Customer Services Department by calling 913 095 456, and indicating the reference number of the reservation. The USER will then be told if the change is possible, and will be informed of the charges involved in making the change.

8.10. Conditions and fees for cancellations.

In order to cancel any tickets, it is necessary to get in touch with our Customer Service Department by calling 913 095 456, and indicating the reference number of the reservation. The USER will be told if the cancellation is possible, and of the charges involved.

9. Hotels.

9.1. Prices.

Local taxes that exist in hotels in certain places (for example Paris, Amsterdam , Rome, Barcelona, the Balearic Islands and New York) are not included in the price of the reservation. These can vary according to the type of hotel and the location, and change according to local rules. These taxes must be paid directly once at the hotel.

If the USER does not arrive at the hotel at the agreed time, he will lose the right to any refund.

9.2. Special Requirements.

Reservations carried out through the WEBSITE, and without the support and advice of our Customer Service Department, do not guarantee that people with special requirements (dietary or other) have all of their needs covered.

In the case of people with Coeliac disease, only a small quantity of the hotels that appear on the WEBSITES can be adapted to their dietary needs. Therefore we strongly recommend that these people only use the online reservation method if they do not have any dietary limitation, or if they know for sure what products they wish to choose.

9.3. Conditions and charges for changes or cancellations.

Our Customer Services (913 095 456) can inform you of the conditions and charges that may occur with any change to or cancellation of a reservation made.

No type of cancellation or refund will be allowed (partial or total) on the same day that your stay in the hotel begins, nor during or after the stay there.

It is possible to check the details of the hotel cancellation policy before confirming the reservation on the website, as well as in the email of confirmation. 10. Holidays.

Package holidays, plane tickets and all other tourist products or services that are offered on the WEBSITE are governed by what is provided in these general conditions, and also by the program or information pamphlet and the general conditions of the WHOLESALE companies with which the USER reserves the service or tourist product.

Specifically, the package holidays offered through the WEBSITE are subject to that provided in the Legislative Royal Decree 1/2007, of the 16th November (Real Decreto Legislativo 1/2007, de 16 de noviembre), which adopted the Revised Text of the General Law for the Protection of Consumers and Users, especially Book IV, concerning travel packages, as well as the applicable regional legislation.

In the event that you wish to purchase cancellation and travel insurance, you will only be able to do so on the same day that you make your booking. It will be impossible to this afterwards.

The entire cost will be charged to the USER’s credit card.

In the event that the booking is subject to availability, if in the end it is not possible to make the booking, and an alternative offered by the wholesale company is not possible or not accepted, the reservation will be cancelled, with the total price of the booking refunded without any further charges or processing fees.

However, once the booking has been confirmed, the cancellation conditions specified above will apply.

In the case of a rise in the price of fuel, this would be reflected in the price of the airport taxes, with the wholesaler able to ask for an increase, granted under article 157 of the Legislative Royal Decree 1/2007, on the 16th November (Real Decreto Legislativo 1/2007, de 16 de noviembre) from the General Law for the Protection of Consumers and Users. In this case, our Customer Service Department will get in touch with you to inform you of the amount of the increase and to request the details of your credit card in order to be able to make the payment.
